1. About these terms
These terms govern the use of Sameeti — the web dashboard at sameeti.com, the Sameeti Resident app and the Sameeti Guard app (together, the “Service”). The Service is provided by TWS Technology, a sole proprietorship having its place of business at A-23/1, Shyam Nagar, Devli Arab Road, Borkhera, Kota, Rajasthan 324001, India (GSTIN 08BYZPM7289P1ZS) (“we”, “us”, “our”).
By creating an account, signing up a society, or using the Service, you agree to these terms and to our Privacy Policy and Refund & Cancellation Policy. If you are accepting on behalf of a society, association or company, you confirm that you are authorised to do so.
2. Definitions
- Society — the housing society, apartment association, RWA, property manager or other organisation that subscribes to the Service.
- Administrator — a committee member, manager or other person the Society authorises to manage its account.
- Users — everyone the Society gives access to, including administrators, staff, security guards, residents, owners and tenants.
- Society Data — information entered into the Service by or for the Society, including details of flats, residents, staff, visitors, payments and documents.
3. Accounts and eligibility
- You must be at least 18 years old to create an administrator account. Residents below 18 may be added by a parent or guardian as family members.
- You must give accurate information and keep it up to date.
- You are responsible for keeping passwords and OTPs confidential and for all activity under your account. Tell us immediately at contact@sameeti.com if you suspect unauthorised use.
- The Society decides who gets access and what role they have. Administrators can add, change or remove Users at any time.
4. Responsibilities of the society
The Society controls the personal data it puts into the Service and decides why it is used. For the purposes of the Digital Personal Data Protection Act, 2023, the Society acts as the data fiduciary for Society Data and we act as its data processor. The Society agrees to:
- collect personal data of residents, staff and visitors lawfully, give them any notice required, and obtain consent where needed — including before uploading identity documents such as Aadhaar or PAN;
- only upload data it is entitled to share, and keep it accurate;
- handle requests from its members to access, correct or erase their data, with our help where needed;
- follow applicable laws on messaging, including TRAI rules for commercial SMS and WhatsApp’s policies for business messages.
5. Acceptable use
You must not:
- use the Service for anything unlawful, or to harass, threaten, defame or discriminate against anyone;
- send spam or promotional messages to people who have not agreed to receive them;
- upload malware, try to break or bypass security, or access data you are not authorised to see;
- copy, resell, reverse engineer or build a competing product from the Service;
- overload the Service with automated requests, except through an API we provide for that purpose.
6. Plans, fees and billing
- Plans are priced per flat (unit) per month, as shown on our pricing section or in a quote we send you. GST is charged extra at the applicable rate.
- Unless agreed otherwise in writing, fees are billed monthly in advance, based on the number of flats in your plan.
- App push notifications and emails are included. SMS and WhatsApp messages are included up to the monthly credits of your plan, pooled across the Society. Unused credits do not carry forward. Messages beyond the credits are charged from a prepaid message wallet at the rates shown when you top up.
- A free trial or founding-society pricing, if offered, applies for the period and on the terms communicated to you at the time.
- If an invoice is not paid within 15 days of its due date, we may, after giving notice, suspend access until it is paid. Your data is not deleted because of a payment delay during the notice and suspension period.
- We may change prices with at least 30 days’ notice. New prices apply from your next billing cycle after the notice period.
7. Cancellation and refunds
You can cancel at any time. Cancellation takes effect at the end of the current billing month. Refunds are handled as described in our Refund & Cancellation Policy.
8. Your data
- Society Data belongs to the Society. We use it only to provide, secure, support and improve the Service, as described in our Privacy Policy. We do not sell personal data.
- Administrators can export key data (such as flat lists and accounting data) from the Service. On request, we will help with an export before your account closes.
- After cancellation or termination, we delete Society Data within 30 days, except records we must keep by law — for example invoices and accounting records, which we retain for up to 8 years — and routine backups, which are overwritten on their normal cycle.
9. Third-party services
The Service relies on third parties for hosting, SMS, WhatsApp (Meta), push notifications (Google Firebase), email and, where used, payment collection. Their services are subject to their own terms. We are not responsible for delays or failures caused by these providers, telecom networks or app stores, but we will work with them to resolve problems that affect you.
10. Availability and support
We aim to keep the Service available at all times, but it may be interrupted for maintenance, updates or reasons beyond our control. We will try to give advance notice of planned maintenance. Support is available by email and WhatsApp; we usually respond within 24 hours on working days.
11. Security features are aids, not guarantees
Visitor management, gate passes, OTPs, alerts and SOS features help the Society manage security, but they do not replace trained guards, physical security or emergency services. Decisions at the gate remain the responsibility of the Society and its staff. In an emergency, always call 112 or the relevant emergency service. Notifications can be delayed or missed due to network, device or third-party issues.
12. Intellectual property
The Service, including its software, design, logos and the Sameeti name, belongs to TWS Technology. We give the Society and its Users a limited, non-exclusive, non-transferable right to use the Service during the subscription. If you send us feedback or suggestions, we may use them without any obligation to you.
13. Disclaimer
The Service is provided “as is” and “as available”. Reports, calculations and templates — including GST, TDS and accounting outputs — are tools to assist you; they are not legal, tax or accounting advice. Please have your accounts and filings reviewed by a qualified professional.
14. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special or consequential losses, or for loss of profits, revenue or goodwill. Our total liability for any claim relating to the Service is limited to the fees the Society paid us for the Service in the three months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited under Indian law.
15. Indemnity
The Society agrees to indemnify us against claims by third parties arising from Society Data it uploads without the right to do so, or from its breach of these terms or of applicable law.
16. Suspension and termination
We may suspend or terminate access, with notice where reasonably possible, if fees remain unpaid after notice, if these terms are seriously breached, or if required by law. We may suspend individual Users immediately to protect the Service or other Users from harm. Sections on data, intellectual property, disclaimer, liability, indemnity and governing law survive termination.
17. Changes to these terms
We may update these terms from time to time. For material changes, we will notify administrators by email or in the Service at least 15 days before they take effect. Continuing to use the Service after that means you accept the updated terms.
18. Governing law and disputes
These terms are governed by the laws of India. We will first try to resolve any dispute through good-faith discussion. If it cannot be resolved within 30 days, the courts at Kota, Rajasthan shall have exclusive jurisdiction.
